In-depth Cooperation: Hand-in-Hand for Win-win Results
——The 3rd Visit to BAC by MSOD Project Team from Pepperdine University

From March 17th through the 21st 2008, the MSOD (Master of Science of Organization Development) Project Team from Graziadio School of Business & Management at Pepperdine University, in Southern California, USA, made its 3rd visit to BAC. The members of Project Team had a symposium with the Secretary-General, arbitrator representatives, and secretaries of the BAC. Both parties communicated on issues such as the configuration of the rights and responsibilities for Commission, and how to establish a mature organizational structure for the sustainable development, etc. In its research report, by comparing the similarities and differences between BAC and the similar international and domestic arbitration organizations, MSOD Project Team analyzed the advantages and challenges faced by BAC in terms of the management system, and gave expert suggestions for the issues faced in its organizational development.

I. Introduction on MSOD Project Team

The MSOD Project Team is a graduate program established for business executives and students with senior management experience, and is very reputable in America. Most of its students are senior managers in large American companies, involving several professional fields such as finance, law, public relation and human resources, etc. As a final project, they will select some organizations and institutions with rapid worldwide development as the objects of their research, and then apply the analytical concepts learnt in the program through the lens of their own experience. They will carry out in-depth analyses and issue the research reports for the development status of those organizations.

II. Cooperation history

The BAC is an arbitration organization with the most rapid development in China, whose rapidly increasing case number and international reputation have drawn attention from the world, and also attracted the attention and interest of the MSOD Project Team. From March 20th through the 23rd, 2006, professors and students of the MSOD Project Team came to visit BAC for the first time, and had a 4-day study and research, completed a report titled, “Bow Only to the Truth,” in which, they specifically analyzed the various external factors and internal reasons for the success of BAC, and offered high praise of the BAC’s constant efforts in striving to promote private and internationalized arbitration.

From March 19th through the 22nd, 2007, the MSOD Project Team visited BAC again; further studying and analyzing the reforms on the internal management system in BAC from the previous year, and carrying out the in-depth research on subjects such as the development guidelines and the management structure of the BAC. In its research report, its students specifically analyzed the opportunities and challenges faced by BAC in its continuous development, and proposed the suggestions such as arbitrator compensation should be connected with the international traditions and an international commercial case department should be established for the long-term development objective in the BAC internationalization process.

III. Hand-in-Hand for Win-Win results

During the past three years, the in-depth cooperation between BAC and MSOD Project Team in terms of research on the organization management system has enabled the both parties to achieve win-win results in various aspects. Since its foundation, BAC has set its objective to become an internationally recognized arbitration organization, and during the past decade, it has stuck to the reforms and innovations, learnt from others, and continuously absorbed internationally advanced management concepts, to improve its internal management structure. All the members of MSOD Project Team have the rich experiences in organization management. They are experts in the operation management field, and have their own unique opinions for the operation and development of an organization. The research reports they proposed play a very important reference role for the BAC to improve its internal management system and officially march into the international arbitration field. In addition, the cooperation with MSOD Project Team also has the positive significances for promoting the Chinese arbitration and improving the international influences of BAC.

For the MSOD Project Team, China is one of the countries with the most rapid development in today’s world; Chinese organizations are in a period of fierce reform. Thus, these companies provide precious opportunities research on the subject of organizational development. As an arbitration organization that is aggressively dedicated to reform practices, BAC is an excellent example in which to study issues such as the development course of the arbitration business in China and the evolution of the internal management systems in arbitration organizations. The thirst for new knowledge and a management mode of continuous innovation and improvement at the BAC inspired creativity and enthusiasm in the project team, and motivated them to put a great deal of effort into their analysis.

All disputes arising from or in connection with this contract shall be submitted to Beijing Arbitration Commission / Beijing International Arbitration Center for arbitration in accordance with its rules of arbitration. The arbitral award is final and binding upon both parties.
