Introduction to the Beijing Arbitration Commission
The Beijing Arbitration Commission (¡°BAC¡±) is a not-for-profit permanent organization devoted to the providing of a forum for impartial and efficient alternative dispute resolution including arbitration and mediation.
Structure
The BAC was founded on September 28, 1995 following the passage of
the Arbitration Law of the People¡¯s Republic of China. The Commission is run by a standing committee of twelve (¡°Committee¡±), including a Chairman (currently Prof. Jiang Ping), four vice-Chairman, and seven committeemen. Below the Committee, is the Office (¡°Office¡±), which deals with day-to-day operations and is headed by the Secretary-General, Madam Wang Hongsong and a staff of over twenty managing secretaries. The Office is capable of providing state-of-the-art technological services for arbitrations, thus ensuring effective and better case-handling.
The BAC focuses on contractual and property-related disputes, both commercial and international, among citizens, legal persons and other organizations. Since its founding, the BAC has grown into the foremost arbitration commission in China. From an initial annual load of only a handful of cases, today the BAC consistently ranks among the top in both cases accepted and total disputed amount.
The BAC provides its services to both domestic and foreign parties and its Panel of Arbitrators includes over fifty well-established foreign arbitrators. It participates in international seminars and trains its arbitrators in international ADR practices.
BAC arbitrations emphasize three qualities:
Impartiality: In regards to impartiality the BAC remains the arbitration commission economically independent of the government, thus ensuring a minimum of state intrusion or conflicts of interest. Parties moreover have the ability to challenge any arbitrators who appear biased.
Expertise: Arbitrators are selected on the basis of expertise and include some of the foremost experts in law, trade, economics, business practices as well as other fields. These arbitrators are well-trained in dispute resolution and are required to adhere to strict ethical standards as set by the BAC.
Finality: All BAC arbitrations are final binding on parties.
